Governor Kathy Hochul signed this bill into law in December 2024 and it came into effect in June 2025. It creates new responsibilities and requirements for model management companies, model management groups and clients to provide basic protections for models and content creators in the New York fashion industry.
Key Aspects
Establishes a fiduciary duty requiring management agencies to act in the best interests of their talent.
Provides models with copies of contracts and agreements.
Protects the health and safety of models, including by establishing a zero-tolerance policy for abuse.
Obtains clear written consent for the creation or use of a model's digital replica, detailing the scope, purpose, rate of pay and duration of such use.
Requires management agencies to discontinue bad practices such as:
Charging models interest on payment of their earnings.
Renewing the contract without the model's affirmative consent.
Taking retaliatory action against a model for filing a complaint.
Latest Update
As of December 2025, model management companies and model management groups must register with the New York State Department of Labor and comply with any registration-related requirements.
