Governor Newsom signed this bill into law in September 2022 and the main prohibition took effect on January 1, 2025. It makes California the first state to phase out the use of toxic “forever” PFAS chemicals in clothes and textiles.
Key Aspects
Bans PFAS in most new clothing (including outdoor apparel) and textiles starting on January 1, 2025.
Bans PFAS in outdoor apparel for severe wet conditions that is not marketed for general consumer use and is designed for sports experts starting 2028, but manufacturers will have to disclose that the products are made with PFAS chemicals during 2025-2028, including on online listings.
Bans all intentional uses of PFAS in clothes and textiles, as well as any levels above 100 parts per million (ppm) from 2025-2027, and any levels above 50 ppm after 2027.
Imposes maximum daily penalty of $10,000 per violation. Distributors and retailers will not be found to have violated the law if they relied in good faith on a compliance certification provided by a manufacturer.
